01 Acceptance of terms
By accessing or using Price & Pick (the "Site"), you agree to be bound by these Terms of Use ("Terms"). If you don't agree with any part of these Terms, please don't use the Site. Continuing to use the Site means you accept these Terms in full.
These Terms apply to all visitors, registered users, newsletter subscribers, and anyone who interacts with our content. They work alongside our Privacy Policy, Affiliate Disclosure, and Cookie Policy to form the complete agreement between you and Price & Pick.
You must be at least 18 years old (or 16 in the EU with parental consent) to use the Site or create an account. By using the Site, you represent that you meet this age requirement. See section 10 of our privacy policy for our complete children's privacy practices.
02 Using our site
You may access and use the Site for personal, non-commercial purposes — reading reviews, browsing awards, comparing products on our comparison tool, subscribing to our newsletter, and engaging with our blog.
What you agree NOT to do
- Scrape, copy, or republish our content in bulk without written permission
- Use automated tools (bots, scrapers, crawlers) to access the Site beyond what's allowed by our robots.txt
- Reverse-engineer the Site, its code, or our scoring algorithms
- Attempt to gain unauthorized access to any part of the Site, accounts, or servers
- Interfere with the Site's operation via DDoS, malware, or any disruptive activity
- Use the Site to violate any law or transmit illegal content
- Impersonate Price & Pick, our team members, or other users
- Resell or commercially exploit our content, scores, awards, or recommendations without permission
Violations: If you violate these rules, we may suspend your access, delete your account, or pursue legal action. We reserve the right to investigate and take action without prior notice in cases of serious abuse.
03 Accounts & access
Most of the Site is freely accessible without an account. If you create an account via the sign-in page, you agree to provide accurate information and keep it up to date.
Your account responsibilities
- Keep your password secure — don't share it with anyone
- Notify us immediately if you suspect unauthorized access via the contact page
- You're responsible for all activity under your account, even if someone else used it
- One person per account — accounts are not transferable
- Provide accurate information and update it when it changes
You can delete your account at any time by emailing our team via the contact page. We process deletion requests within 30 days. See section 06 of our privacy policy for our complete data retention practices.
04 Our content & intellectual property
All content on the Site — including reviews, articles, photographs, graphics, logos, scoring rubrics, methodology, and the underlying code — is owned by Price & Pick or licensed to us. It's protected by copyright, trademark, and other intellectual property laws.
What you can do
- Read, view, and link to our content for personal use
- Quote brief excerpts (under 200 words) with proper attribution and a link back to the original page
- Share links to our content on social media or other platforms
- Print pages for personal reference (not redistribution)
- Cite our reviews in academic, journalistic, or editorial contexts with proper attribution to "Price & Pick"
What requires written permission
- Republishing entire articles or substantial portions on other sites
- Bulk use of our scores or awards in commercial products
- Translating our content into other languages
- Using our logos or trademarks beyond simple attribution
- Creating derivative works based on our methodology or scoring rubric
For permission requests, contact our team via the contact page or our press team. We typically grant editorial and academic use within 24-48 hours; commercial use is reviewed case-by-case.
05 Content you submit to us
Sometimes you'll submit content to Price & Pick — a comment, a product review suggestion via our contact page, a question to our help center, or feedback on a published review. These Terms govern your submissions.
What you grant us when you submit content
By submitting content to us, you grant Price & Pick a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, and publish that content in connection with our editorial work. This includes quoting your feedback in published articles, using product suggestions to inform our testing pipeline, and improving our content based on your input.
You retain ownership of your content. We don't claim copyright over your submissions — we just need permission to use them in our editorial work. You can withdraw permission at any time by emailing us via the contact page.
What you must NOT submit
- Content you don't own or don't have permission to share
- Defamatory, harassing, or threatening content
- Content that violates someone else's privacy or intellectual property
- Spam, advertising, or promotional content
- False or misleading product reports intended to manipulate our recommendations
- Confidential information belonging to a brand or employer
We reserve the right to remove any user-submitted content that violates these Terms, without notice and at our sole discretion.
06 Affiliate links & purchases
Price & Pick earns affiliate commissions when readers click outbound links to retailers and complete purchases. Read our complete affiliate disclosure for full transparency on how this works and why it doesn't influence our rankings.
Important: your transaction is with the retailer
When you click an outbound link from Price & Pick to a retailer's website (Amazon, Best Buy, Apple, Lululemon, etc.), you leave our Site and enter the retailer's site. Any purchase you make is between you and that retailer — not Price & Pick.
This means:
- The retailer's terms govern your purchase, returns, refunds, and warranty
- The retailer handles payment processing, shipping, and customer support
- Price & Pick is not a party to your transaction and cannot intervene in disputes
- If a product fails or arrives damaged, contact the retailer directly — not us
What we will help with: If you have feedback about a product we recommended that arrived damaged, didn't perform as described, or fell short of our review — please tell us via the contact page. We'll factor your feedback into our quarterly review refresh and may demote products that fail post-publication.
07 Disclaimers
The Site is provided "as is" and "as available," without warranties of any kind, either express or implied.
Editorial recommendations are opinions
Our reviews, scores, and award designations represent the editorial team's opinions based on our testing methodology. While we test rigorously and follow the methodology documented here, our opinions may differ from yours. Final purchase decisions are yours.
No guarantees
- Product availability and pricing change frequently — we update our content quarterly, but information may become stale
- Coupon codes may expire or fail at the retailer's discretion
- Product specifications, features, and quality may change after our review without notice
- Sites we link to are operated by third parties — we don't control their content, security, or practices
- Site availability — we strive for high uptime but don't guarantee uninterrupted access
Legal Notice
To the maximum extent permitted by applicable law, Price & Pick disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.
08 Limitation of liability
To the maximum extent permitted by applicable law, Price & Pick and its team members will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or any product purchased through our links.
This includes but isn't limited to
- Loss of profits, revenue, or data
- Loss of goodwill or reputation
- Cost of substitute products or services
- Unauthorized access to your account or data (despite our security practices)
- Errors or omissions in our content, scores, or recommendations
- Defects, damages, or injuries related to products you purchase from retailers we link to
Our total liability for any claim arising from these Terms or your use of the Site will not exceed the greater of $100 USD or the amount you paid Price & Pick directly in the 12 months preceding the claim (which, since the Site is free, is typically $0).
Jurisdictional Note
Some jurisdictions don't allow exclusion of certain warranties or limitation of liability for incidental or consequential damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law. These limitations apply even if we've been advised of the possibility of such damages.
09 Indemnification
You agree to indemnify and hold harmless Price & Pick, its team members, and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:
- Your use of the Site in violation of these Terms
- Your violation of any third-party rights, including intellectual property or privacy rights
- Content you submit to us that violates these Terms or applicable law
- Your violation of any applicable law or regulation
- Unauthorized use of your account resulting from your failure to maintain account security
This indemnification obligation will survive termination of these Terms and your use of the Site.
10 Termination
You can stop using the Site any time. If you have an account, you can delete it via the contact page. We process deletion requests within 30 days.
Price & Pick reserves the right to suspend or terminate your access to the Site (including any account) at any time, with or without notice, if:
- You violate these Terms or any other applicable policies
- You engage in fraudulent or abusive behavior
- You violate someone else's rights through use of the Site
- You attempt to interfere with the Site's operation or security
- Required by law or court order
Upon termination, your right to use the Site ends immediately. Sections of these Terms that by their nature should survive termination — including ownership provisions, warranty disclaimers, indemnity, and limitations of liability — will survive.
11 Governing law & disputes
These Terms are governed by and construed in accordance with the laws of the jurisdiction where Price & Pick is established, without regard to conflict-of-laws principles.
How we handle disputes
If you have a dispute with us, please contact us first via the contact page. We'd much rather resolve issues directly than through formal legal proceedings. We respond to all disputes within 7 business days and try to find amicable resolutions.
If we can't resolve a dispute informally, both parties agree to:
- First, attempt mediation — using a mutually agreed-upon mediator before pursuing formal proceedings
- Resolve disputes individually — no class actions, class arbitrations, or representative proceedings
- Submit to exclusive jurisdiction of courts in our principal place of business for any proceedings
- Bring claims within 1 year of when the dispute arose — claims older than this are waived
Jurisdictional Note
Nothing in this section limits your rights under applicable mandatory consumer protection laws or your right to seek small claims court resolution where available. EU and UK readers retain their full rights under local consumer protection regulations.
12 Changes to these terms
We may update these Terms occasionally to reflect changes in our practices, services, or legal requirements. When we make material changes, we'll:
- Update the "Last updated" date at the top of this page
- Notify subscribers via email if you've signed up for our newsletter
- Display a banner on the Site for 30 days after significant changes
- Highlight changed sections on this page for the first 30 days after the update
Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms. If you don't agree with the changes, you should stop using the Site and may delete your account via the contact page.
For material changes that significantly reduce your rights, we'll provide at least 30 days' advance notice before the changes take effect, giving you time to review and decide whether to continue using the Site.
